ELSEWHERE BY EDEN

TERMS OF SERVICE

Effective August 27, 2026

These Terms of Service (“Terms”) govern your access to and use of elsewherebyeden.com (the “Website”) and your purchase or use of products and services offered by Elsewhere by Eden, LLC (“Elsewhere by Eden,” “we,” “us,” or “our”). By accessing the Website, creating a customer account, placing an order, purchasing a subscription, or otherwise using our services, you agree to these Terms and to the policies incorporated into them.

Please read these Terms carefully. If you do not agree to these Terms, you should not use the Website or purchase products or services through it.

1. About Elsewhere by Eden

Elsewhere by Eden is a Georgia-based creative business offering illustrated paper goods, correspondence, art prints, written and journal content, and related products. The Wanderer’s Post is Elsewhere by Eden’s recurring monthly mail subscription. Additional products, collections, features, and services may be offered through the Website from time to time.

2. Eligibility and Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. By making a purchase, you represent that you have legal capacity to enter into the transaction or are otherwise authorized to do so. You are responsible for ensuring that information you submit through the Website is accurate and that your use of the Website complies with applicable law.

3. Customer Accounts

Certain Website features may allow or require a customer account. You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You agree to provide accurate information and to update it when necessary. If you believe your account has been accessed without authorization, contact eolivia@elsewherebyeden.com promptly. We may suspend or restrict an account when reasonably necessary to protect customers, the Website, or our business.

4. Products and Creative Collections

Elsewhere by Eden offers physical and creative products that may be produced in limited quantities. Product descriptions, dimensions, materials, photographs, illustrations, mockups, and previews are provided to help customers understand the product. We make reasonable efforts to present products accurately, but minor variations in screen color, printing, paper, trimming, placement, hand-finished details, or other production characteristics may occur. Such ordinary variations do not necessarily constitute a defect.

5. Product Availability

Products and collections are subject to availability. We may limit quantities, close a collection when available inventory is reached, discontinue an item, or change future product offerings. Adding an item to a cart does not necessarily reserve it. An order is subject to acceptance and successful payment. If we accept payment for an order that we later determine we cannot fulfill, we will provide an appropriate refund or other remedy.

6. Prices, Taxes, and Payment

Prices are stated in U.S. dollars unless otherwise indicated. Applicable sales, use, or similar taxes will be collected when required by law and displayed at checkout or on the transaction record. You agree to pay the amount shown at checkout. Payments are processed through Squarespace and the applicable payment processor. We may correct an obvious pricing, calculation, or listing error and, where necessary, cancel and refund an affected order rather than fulfill it at an erroneous price.

7. The Wanderer’s Post

The Wanderer’s Post is a recurring monthly subscription currently priced at $12.00 per month, plus applicable sales tax and shipping charges where applicable. Standard U.S. postage is included in the $12.00 subscription price. International subscriptions are subject to an additional flat-rate shipping fee based on the destination, which will be displayed at checkout before purchase. The subscription automatically renews monthly on the anniversary of the date the subscriber originally enrolled until canceled. Detailed terms governing enrollment, recurring billing, collection assignment, monthly cutoffs, shipping, cancellation, and other subscription matters are contained in the separate Subscription Terms, which are incorporated into these Terms by reference.

8. Orders

An order submitted through the Website constitutes an offer to purchase the selected product or service under the terms displayed at checkout and these Terms. We may decline or cancel an order for a legitimate reason, including payment failure, suspected fraud, pricing or listing error, inventory limitation, inability to fulfill, shipping restrictions, misuse of an offer, or violation of these Terms. If we cancel a successfully paid order that will not be fulfilled, we will issue an appropriate refund.

9. Order Information

You are responsible for providing accurate billing, shipping, contact, and order information. We are not responsible for problems caused solely by inaccurate or incomplete information supplied by the customer. If you discover an error, contact us promptly. We will make reasonable efforts to correct information before fulfillment but cannot guarantee changes after an order has entered fulfillment.

10. Shipping, Delivery, Returns, and Refunds

Shipping, delivery, returned mail, postal delays, damaged or incorrect items, replacements, final-sale terms, and refunds are governed by our Shipping & Returns Policy, which is incorporated into these Terms by reference. The Wanderer’s Post and other physical paper goods are final sale except for damaged, incorrect, unfulfilled, or other orders for which a remedy is provided by our policy or required by applicable law.

11. Subscription Cancellation

The Wanderer’s Post may be canceled through the subscription-management functionality available on the Elsewhere by Eden Website. Cancellation stops future recurring charges after it becomes effective but does not automatically refund a subscription charge already processed. Complete cancellation terms are contained in the Subscription Terms.

12. Promotions, Discounts, and Offers

We may offer promotions, discount codes, introductory pricing, gifts, or other special offers. Such offers may be subject to separate eligibility requirements, dates, quantity limits, exclusions, or other conditions disclosed with the offer. Unless expressly stated otherwise, promotions cannot be combined, have no cash value, and may be modified or withdrawn prospectively. We may refuse use of a promotion that is fraudulent, unauthorized, expired, or inconsistent with its stated terms.

13. Intellectual Property

Unless otherwise stated, the Website and the original content created for Elsewhere by Eden—including the Elsewhere by Eden name and branding, The Wanderer’s Post branding, illustrations, artwork, photographs, written correspondence, essays and journal content, graphics, product designs, layouts, patterns, collection concepts, logos, website copy, and other creative materials—are owned by Elsewhere by Eden or used with permission and are protected by applicable copyright, trademark, and other intellectual-property laws. All rights not expressly granted are reserved.

14. Personal, Non-Commercial Use

Purchasing a physical Elsewhere by Eden product gives you ownership of that particular physical item; it does not transfer copyright, trademark rights, reproduction rights, or other intellectual-property rights in the artwork, writing, design, photograph, or other creative content embodied in the item. Unless we give prior written permission, Elsewhere by Eden content and products may not be copied, scanned, reproduced, republished, distributed, commercially resold as reproductions, modified for commercial use, used to manufacture other products, or otherwise commercially exploited. You may use and display purchased physical products for ordinary personal purposes and may give them as gifts.

15. Website Content

Website content is provided for general informational, creative, and commercial purposes. You may view and use the Website for personal, lawful purposes related to learning about or purchasing Elsewhere by Eden products. You may not systematically download, scrape, copy, reproduce, republish, or commercially exploit Website content without authorization, except as permitted by law.

16. User Submissions and Communications

If you voluntarily send us feedback, reviews, photographs, comments, suggestions, or other content, you represent that you have the right to provide that material and that doing so does not violate another person’s rights. We will not publicly use customer-created photographs, testimonials, or other identifiable promotional content as an endorsement without permission where permission is required. Ordinary customer-service communications may be retained as reasonably necessary to resolve requests and maintain business records.

17. Prohibited Conduct

You may not use the Website to violate applicable law; commit fraud; submit false payment or identity information; interfere with Website operation or security; attempt unauthorized access to accounts or systems; transmit malicious code; scrape or harvest protected Website content or personal information through unauthorized automated means; infringe intellectual-property or privacy rights; harass or harm another person; or otherwise misuse the Website or our services. We may restrict access or cancel transactions associated with material misuse, subject to applicable law.

18. Third-Party Services

The Website relies on third-party services, including Squarespace and payment, postal, email, analytics, and technology providers. We may also link to independent websites, social-media platforms, or other services. We do not control independent third-party websites or their terms, privacy practices, availability, or content. Your use of a third-party service may be subject to that provider’s terms and policies.

19. Privacy

Our collection and use of personal information are described in the Elsewhere by Eden Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you acknowledge the privacy practices described there. Third-party service providers may process information under their own privacy policies.

20. Website Availability

We aim to keep the Website available and accurate, but we do not guarantee uninterrupted or error-free access. Website functionality may be temporarily unavailable because of maintenance, technical problems, third-party outages, security measures, updates, or circumstances outside our reasonable control. We may modify or discontinue Website features prospectively.

21. Errors and Corrections

Despite reasonable efforts, the Website may occasionally contain typographical errors, inaccurate descriptions, outdated information, incorrect availability, or technical errors. We may correct errors and update information. If an error materially affects a completed order, we will communicate with the customer when appropriate and provide a lawful resolution, which may include cancellation and refund rather than fulfillment under materially erroneous terms.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website is provided on an “as is” and “as available” basis. We do not warrant that the Website will always be uninterrupted, secure, or error-free. Physical products are subject to the descriptions and policies provided at purchase. Nothing in these Terms disclaims or limits any warranty, consumer protection, or other right that cannot legally be disclaimed or limited.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Elsewhere by Eden will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to use of the Website, delayed postal delivery, inability to access the Website, or use of products, except where such liability cannot legally be excluded or limited. To the fullest extent permitted by law, our aggregate liability arising from a particular purchase will not exceed the amount paid to Elsewhere by Eden for the product or transaction giving rise to the claim. These limitations do not apply where prohibited by law.

24. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, postal or carrier disruptions, labor disruptions, governmental actions, utility or internet failures, widespread technology outages, supply interruptions, or similar events. When such an event affects a paid order, we will make reasonable efforts to communicate material delays and provide any remedy required by applicable law.

25. Indemnification

To the extent permitted by law, you agree to be responsible for losses, liabilities, or reasonable costs resulting from your unlawful misuse of the Website, infringement of another person’s rights through content you submit, fraud, or material violation of these Terms. This provision does not require a consumer to indemnify Elsewhere by Eden for our own unlawful conduct, negligence, or obligations that cannot legally be shifted to the consumer.

26. No Waiver

If Elsewhere by Eden does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later. A waiver of one provision or breach does not constitute a waiver of another provision or later breach.

27. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. The affected provision will be limited or interpreted as necessary to make it enforceable where permitted.

28. Governing Law

These Terms and transactions with Elsewhere by Eden are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except to the extent another jurisdiction’s non-waivable consumer-protection law applies. Nothing in these Terms is intended to deprive a consumer of rights that cannot legally be waived.

29. Changes to These Terms

We may update these Terms prospectively to reflect changes in our Website, products, services, business practices, or applicable law. The effective date at the top identifies the current version. Material changes affecting an existing recurring subscription will also be handled in accordance with the Subscription Terms and applicable law. Changes will not be used to retroactively eliminate a right or remedy that applied to a completed transaction.

30. Entire Agreement and Incorporated Policies

These Terms, together with the policies and terms expressly incorporated by reference—including the Subscription Terms, Shipping & Returns Policy, Privacy Policy, and any product- or promotion-specific terms disclosed before purchase—constitute the applicable agreement between you and Elsewhere by Eden regarding use of the Website and purchases made through it. If a specialized policy conflicts with these general Terms on a subject specifically governed by that policy, the specialized policy controls for that subject.
